RefrigiWear's email marketing is permission based. Applicable law; jurisdiction and venue

You agree that, in the event any dispute or claim arises out of or relates to your use of the Site or this Privacy Policy that you will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You also agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Atlanta, Georgia with a mutually agreed mediator in an attempt to resolve the dispute. In the event that the dispute or claim remains unresolved after mediation, arbitration shall be the sole and exclusive method to resolve such disputes or claims. In the event that any such claims or disputes cannot be resolved through arbitration, any legal actions shall be governed by the internal laws of the state of Georgia, without reference to its choice of law provisions, and federal law, if applicable. If there is a dispute between you and us, you expressly agree that exclusive jurisdiction and venue reside in the state or federal courts located in Fulton County, Georgia, United States, and you expressly waive any objection as to venue or personal jurisdiction.  In the event of any such action, you hereby expressly agree to accepting service of process via electronic communication.

Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.

Non-U.S. users; waiver

Information you provide to us through this Site or which is collected by this Site may be governed by U.S. privacy and data protection laws, which may be different from the privacy and data protection laws of other countries. Your use of the Site or submission of information through the Site signifies your consent to the applicability of the privacy and data protection laws of the United States. By using this Site, you hereby waive and release any and all claims, liabilities, losses, damages, costs and expenses (including, without limitation, reasonable attorneys' fees and other dispute resolution expenses) arising from or relating to any alleged or actual violation or breach of the privacy and data protection laws of any foreign country by virtue of your use of this Site.
